WhatIP.ca provides network diagnostic and IP information tools including but not limited to:

• IP address geolocation and information lookup
• DNS query and WHOIS lookup services
• Network diagnostic tools (ping, traceroute, port scanning)
• Email deliverability and mail server diagnostic tools
• IP reputation and security analysis
• Network monitoring services (for registered users)

3. Use Restrictions and Prohibited Activities

3.1 Permitted Use

The Service is provided for educational and informational purposes only. You may use the Service to:

• Diagnose and troubleshoot your own networks and systems
• Research and learn about network protocols and internet infrastructure
• Verify information about IP addresses and domains you own or have authorization to query

3.2 Prohibited Use

You agree NOT to use the Service to:

• Engage in any illegal activity or violation of applicable laws
• Scan, probe, or test the vulnerability of any system or network without proper authorization
• Breach or circumvent any security or authentication measures
• Access data not intended for you or log into servers or accounts you are not authorized to access
• Conduct denial of service attacks or attempt to disrupt service to any user, host, or network
• Harass, threaten, or harm any individual or organization
• Distribute malware, viruses, or other harmful code
• Resell, redistribute, or commercially exploit the Service without written authorization
• Use automated tools, bots, or scripts to excessively query the Service
• Violate any third party's intellectual property or privacy rights

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate, reliable, or complete
• Any errors in the Service will be corrected
• The Service will meet your specific requirements

You acknowledge that network diagnostic results may vary and should be independently verified for critical applications.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our total liability exceed the amount you paid to us in the 12 months preceding the claim, or $100 CAD, whichever is less.

8. Indemnification

You agree to indemnify, defend, and hold harmless WhatIP.ca and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Your violation of applicable laws or regulations

9. Privacy and Data Protection

Our collection and use of personal information is governed by our Privacy Policy, which complies with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation. By using the Service, you consent to our data practices as described in the Privacy Policy.

10. Intellectual Property

All content, features, and functionality of the Service, including but not limited to software, text, graphics, logos, and trademarks, are owned by WhatIP.ca and protected by Canadian and international copyright and trademark laws. 14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or the Service shall be resolved through:

1. Good faith negotiation between the parties
2. Mediation, if negotiation fails
3. Binding arbitration in Ontario, Canada, if mediation fails

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and WhatIP.ca regarding the Service and supersede all prior agreements and understandings.
